Requirements
- Have a J.D degree from an accredited law school
- Have at least four years of litigation and/or internal investigations experience at a large law firm and/or health insurance company
- Have experience working with health insurance clients, especially in the managed care space, and are familiar with the AKS, FCA, and HIPAA
- Have experience helping clients develop strategies to mitigate litigation and regulatory risk
Responsibilities
- Manage the company’s portfolio of actual and threatened litigation and regulatory investigations by conducting legal research and internal fact-finding, and helping supervise outside counsel
- Conduct internal investigations of potential regulatory violations raised through the company’s various reporting channels
- Provide the company’s Medicare Advantage and Counterpart Assistant teams with practical day-to-day legal advice regarding Centers for Medicare and Medicaid Services (“CMS”) regulations, the Anti-Kickback Statute (“AKS”), the False Claims Act (“FCA”), and the Health Insurance Portability and Accountability Act (“HIPAA”)
- Proactively identify areas of litigation and regulatory risk, and develop strategies to mitigate such risk
- Draft and negotiate customer contracts for Counterpart Health
