This role requires extensive experience in ERISA and related laws, advising plan sponsors on compliance and risk management. You will also provide general corporate legal counsel.

Requirements

  • At least 10+ years of corporate legal practice, including experience as an in-house attorney, serving as a General Counsel and/or in another senior in-house legal role, and 3+ years of law firm training
  • Deep experience with the Employee Retirement Income Security Act of 1974 (ERISA) and related federal and state laws, with a focus on representing plan sponsors (employers) in plan design, compliance, and risk management
  • Substantive legal experience as a broad corporate generalist
  • Demonstrated success as a practical, business-focused, and responsive legal partner
  • J.D. from a nationally accredited law school
  • State bar membership in state where reside/practice

Responsibilities

  • Provide counsel on ERISA compliance for retirement plans, health and welfare benefit plans, and executive compensation
  • Navigate Internal Revenue Code provisions related to qualified plans, health and welfare benefit plans, and nonqualified deferred compensation (including 409A compliance)
  • Draft, review, and maintain plan documents, summary plan descriptions (SPDs), and other participant communications
  • Provide counsel on ERISA preemption and the intersection of federal and state employee benefits laws (including ACA and COBRA compliance)
  • Represent plan sponsors in DOL and IRS investigations, audits, and correction programs, and manage risk proactively
  • Advise employers on ERISA and benefits considerations in corporate transactions, mergers, and acquisitions
  • Counsel on plan amendments, terminations, and de-risking strategies for ongoing plan management
  • Collaborate with third-party administrators (TPAs), benefits consultants, and other service providers while prioritizing the employer’s perspective
