Summary
Join Affirm's Product Counsel Legal team as a hardworking product lawyer supporting the Direct to Consumer and Merchant Engagement team. You will counsel business teams on consumer financial services laws and regulations, support Affirm's growth and acquisitions, provide strategic legal advice, and monitor legal and regulatory developments. The ideal candidate possesses 6+ years of relevant experience, a JD from a reputable law school, and expertise in consumer credit. You will be a trusted advisor, identifying and evaluating risks, drafting legal documents, and assisting with merchant engagement. Requirements
- 6+ years of related business, government, or fintech experience, preferably with a focus on BNPL or Consumer Payments
- JD from a highly-reputable, ABA-accredited law school
- Established expertise in all areas of the consumer credit lifecycle, including originations, underwriting, licensing, money transmission, fair lending, BSA/AML, servicing, furnishing, & collections
- Admitted to practice law and in good standing in at least one state bar/jurisdiction
- A quick learner who genuinely enjoys legal analysis and collaboration in a fast-paced environment
- Experience developing creative approaches to legal challenges while providing business-focused legal advice
- Inquisitive and proactive in identifying risks and proposing creative and effective solutions
- Strong project management, critical thinking, creativity, and analytical skills
- Someone focused on maintaining positive relationships and trust with cross-functional business partners
- Passion for improving credit products and consumer experiences
Responsibilities
- Counsel Affirm’s Business teams and other cross-functional stakeholders on relevant federal and state consumer financial services laws and regulations affecting new and existing products and services, including the Truth in Lending Act; the Electronic Fund Transfer Act; The Equal Credit Opportunity Act; the Fair Credit Reporting Act; the Bank Secrecy and Anti-Money Laundering Act; laws prohibiting unfair, deceptive and abusive acts and practices; and related regulatory guidance and enforcement actions
- Support Affirm’s growth and acquisition including origination and servicing of BNPL products
- Provide strategic advice regarding state and federal lending, consumer finance and protection laws
- Monitor legal and regulatory developments in consumer lending and servicing
- Be a trusted advisor and teammate, sharing legal and other expertise and support when needed
- Identify and evaluate business and legal risks and act as a trusted partner for creative legal problem-solving
- Draft terms and conditions, disclosures, review copy & consumer user experience
- Assist with merchant engagement as needed
- Create and solve initiatives related to new and existing Affirm products
